General terms and conditions of sale

for a stay in the “Maisons 322” guest rooms.

These general terms and conditions of sale are intended to be used for booking stays in guest rooms at “Maisons 322”, 17520 LE BOIS PLAGE EN RE, France. They constitute the reservation contract between the owners, SAS KIKOSU and SAS HOME IS THE STORY and the client for a stay in a guest room.

Article 1 – Length of stay: The client who signs the contract entered into for a fixed duration will not be able under any circumstances to be entitled to any right to remain in the premises. The owner may accept the extension of the stay for a fee if the room is available after the planned stay.

Article 2 – conclusion of the contract : The reservation shall become effective as soon as the client has sent the owner a deposit of 30% of the total amount of the rental for a stay of 3 nights or more, or all of the payment, i.e. 100% of the amount of the rental for a stay of one or two nights. Payment of the balance less than 30 days before the beginning of the stay. The payment of the deposit implies the acceptance of the GTC. The reservation entered into between the parties may in no event benefit, even partially, any third parties, natural or legal persons. The prices are inclusive of all charges, excluding the tourist tax.

Article 3 – absence of withdrawal : For reservations made by mail, telephone or internet, the client shall not benefit from the withdrawal period, and this in accordance with Article L121- 21-8 of the Consumer Code relating in particular to the provision of accommodation services provided on a date or according to a determined periodicity.

Article 4 – Cancellation by the client : Any cancellation must be notified by registered mail to the owner. If the cancellation occurs more than 30 days before the beginning of the stay, the deposit and/or the payment of the stay will be returned to the client. If the cancellation occurs less than 30 days before the beginning of the stay, the deposit and/or the payment of the stay shall be kept by the owner who reserves the right to claim the balance of the price of the stay. If the client does not communicate (show up??) Before 7 p.m. On the day of the beginning of the stay or does not respect the maximum time of arrival, the owner reserves the right to dispose of his rooms. In case of shortened stay, the price corresponding to the cost of the stay shall be fully kept by the owner.

Article 5 – Cancellation by the owner : If the owner cancels the stay before the beginning of the stay, for reasons beyond his control, he must inform the client as soon as possible by phone or email. The client will be reimbursed immediately for the amount paid.

Article 6 – Arrival time : The client must arrive on the specified day and at the times mentioned below. The rooms are available from 5.30 pm until 7 pm. In case of late or delayed arrival, the client must inform the owner and ask for our “flexible hours” offer.

Article 7 – Check-out time : Rooms must be vacated by 10:30 am at the latest. After noon, without requesting flexible hours, you will be charged an additional night.

Article 8 – Payment of the balance : The balance is to be paid at the arrival at the owner’s. The beverages and additional services not planned must be paid at the end of the stay to the owner. The price of the room is the same for one or two people – excluding breakfast and other services of our concierge.

Article 9 – Payment accepted : Comission-free european credit cards (Visa/Mastercard), AMEX card with a 3.95% commission and American cards with a 2,90% commission, Apple pay, Google pay, bank transfer, cash.

Article 10 – tourist tax : The tourist tax is a local tax that the client must pay to the owner who then transfers it to the French tax authorities. The tourist tax is 3,30€ (renting 5*) or 2,53€(renting 4*) or 0,88€ (B&B) per person over 18 years old and per night. Tourst tax is included in the VAT Price (all tax included price).

Article 11 – Change in rooms : Without the client being able to claim any compensation, the owner reserves the right to change the room initially booked by the client for a room of the same or a higher capacity. In such a case, the cost of the reservation remains unchanged.

Article 12 – capacity : 2 persons maximum per room for all the rooms and no children under 13 years old, nor pets. The reservation is established for a specific number of people. If the number of guests exceeds this number, the owner may refuse the additional guests. This refusal can in no way be considered as a modification or a breach of contract at the initiative of the owner, so that in case of departure of a number of customers higher than those refused, no refund can be envisaged.

Article 13 – Art of living and use of the premises : The respect of a certain art of living is requested from all the guests to guarantee the tranquility of the premises and the comfort of its guests. In addition, “Maisons 322” is a non-smoking area. It is strictly forbidden to smoke in the guest houses. It is also requested not to eat in the rooms. The client agrees to respect the rules of good manners listed in the rooms and in these GTC. The client agrees to return the rooms in perfect condition at the end of the stay and to declare, and assume financially, any possible degradation for which he would be responsible. The adolescents evolving within the property are under the sole responsibility of their parents. Outside visitors (parents, children, friends of resident clients) will not be allowed in our property. Any behavior contrary to good morals and public order will lead the owner to ask the client to leave the premises without any compensation, nor refund, and after payment of the expenses not yet paid. A wifi connection is available free of charge. However, the client remains responsible for all his downloads.

Article 14 – Insurance : The client is responsible for all damages caused by him. He must therefore check whether his insurance policy for his main home includes a holiday extension (vacation rental). The client certifies that he is covered by a civil liability insurance covering his own responsibility and that of the persons accompanying him.

Article 15 – Responsibilities : The photographs presented on our site are not contractual. Even though every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate our Guest Houses give as accurate an idea as possible of the services offered, variations may occur between the time of the reservation and the day of consumption of the service. The owner cannot be held responsible for the nonexecution or the bad execution of the reservation in case of force majeure, the actions of a third party, the actions of a client, in particular the unavailability of the Internet network, impossibility to access the website, external intrusion or computer viruses. Any reservation or payment that are irregular, Inoperative, incomplete or fraudulent for a reason attributed to the client will result in the cancellation of the order at the expense of the client, without prejudice to any civil or criminal action against the latter.

Article 16 – Personal data : In accordance with the law of January 6, 1978, you have the right to access and rectify data concerning you. “Maisons 322” will not transmit the information you have provided to other companies or organizations. It shall use the data solely for the need of the contract.

Article 17 – Disputes : The present General Sales Terms and Conditions are governed by French law. Only the Court with jurisdiction over the Guest House subject to the rental is competent. It is however reminded that a prior attempt at an amicable resolution of the dispute should be sought.

These general terms and conditions of sale may be modified at any time without any notice. The acceptance and compliance with these terms and conditions are deemed acquired as from the payment of the deposit.
